СледÑтвие заблокировало Ñчета кооператива и запрещает выплаты Ñ Ð½Ð¸Ñ… даже на оÑновании Ñудебных решений, не Ð³Ð¾Ð²Ð¾Ñ€Ñ ÑƒÐ¶Ðµ о том, что оно запрещает выплаты налогов и заработной платы Ñотрудникам аппарата кооператива.
СледÑтвие путем ареÑта имущеÑтва пытаетÑÑ Ð·Ð°Ñ…Ð²Ð°Ñ‚Ð¸Ñ‚ÑŒ многомиллиардные активы: оно ареÑтовало около 4 млрд рублей на Ñчетах кооператива, пыталоÑÑŒ воÑÑтановить ареÑÑ‚ недвижимоÑти кооператива на 8 млрд рублей — теперь ÑÑтафету у него принÑла прокурорÑÐºÐ°Ñ Ð³Ñ€ÑƒÐ¿Ð¿Ð° из прокуратуры Санкт-Петербурга и прокуратуры ПриморÑкого района Санкт-Петербурга. ÐŸÐ»ÑŽÑ Ðº Ñтому ÑледÑтвие ареÑтовало на 8 млрд личного имущеÑтва обвинÑемых.

Ð’ первом, «организационном» заÑедании ПриморÑкого районного Ñуда, предшеÑтвующем раÑÑмотрению уголовного дела по ÑущеÑтву, упоминание гоÑударÑтвенного Ð¾Ð±Ð²Ð¸Ð½Ð¸Ñ‚ÐµÐ»Ñ Ð¸Ð· прокуратуры Санкт-Петербурга об Ñтих заÑвлениÑÑ… вызвало Ñмех в зале: по Ñудебной практике моральный ущерб на Ñумму Ñвыше 100 Ñ‚Ñ‹Ñ. рублей удовлетворÑетÑÑ Ñудами в иÑключительных ÑлучаÑÑ…. Ðо Ñти юридичеÑки ничтожные, по Ñути, заÑÐ²Ð»ÐµÐ½Ð¸Ñ Ð¾Ð±ÑŠÑвлÑÑŽÑ‚ÑÑ Ð¾Ñнованием Ð´Ð»Ñ Ð°Ñ€ÐµÑта имущеÑтва.
ЖульничеÑтво Ñ Ð´Ð¾ÐºÑƒÐ¼ÐµÐ½Ñ‚Ð°Ð¼Ð¸
Поток преÑтуплений и правонарушений ÑледÑÑ‚Ð²Ð¸Ñ Ð½Ðµ оÑтанавливалÑÑ Ð´Ð¾ Ñамого поÑледнего Ð´Ð½Ñ Ð¿Ñ€ÐµÐ´Ð²Ð°Ñ€Ð¸Ñ‚ÐµÐ»ÑŒÐ½Ð¾Ð³Ð¾ раÑÑледованиÑ. Они были Ñовершены при потворÑтве людей из команды Колокольцева, требовавших результата любой ценой.
1 Ð´ÐµÐºÐ°Ð±Ñ€Ñ ÐŸÑ€Ð¸Ð¼Ð¾Ñ€Ñкий районный Ñуд вынужден был признать незаконным фактичеÑкий отказ кооперативу «БеÑÑ‚ Вей» в ознакомлении Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ уголовного дела, а также признал, что ÑледÑтвие грубо нарушило УПК, не объÑвив в уÑтановленном порÑдке о завершении ÑледÑтвенных дейÑтвий. Тем Ñамым оно нарушило права вÑех гражданÑких иÑтцов и ответчиков на ознакомление Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ уголовного дела.
При раÑÑмотрении жалобы адвоката кооператива в ПриморÑком районном Ñуде выÑÑнилоÑÑŒ, что ÑледÑÑ‚Ð²ÐµÐ½Ð½Ð°Ñ Ð³Ñ€ÑƒÐ¿Ð¿Ð° ГСУ, поÑледний год формально Ñ€ÑƒÐºÐ¾Ð²Ð¾Ð´Ð¸Ð¼Ð°Ñ Ð·Ð°Ð¼Ð½Ð°Ñ‡Ð°Ð»ÑŒÐ½Ð¸ÐºÐ° ГСУ полковником ÑŽÑтиции Ð.Ð. Винокуровым, а фактичеÑки, как и раньше, подполковником ÑŽÑтиции Е.Ð. Сапетовой, подделала документы (Винокуров был назначен в качеÑтве «крыши», «тарана», поÑкольку ходатайÑтва ÑледÑтвенной группы в первый период раÑÑÐ»ÐµÐ´Ð¾Ð²Ð°Ð½Ð¸Ñ Ð¾Ñ‡ÐµÐ½ÑŒ плохо проходили в Ñудах).
Жалоба была подана адвокатом кооператива в июле, много раз ее раÑÑмотрение откладывалоÑÑŒ и ÑоÑтоÑлоÑÑŒ в декабре. Ð£Ð»Ð¸Ñ‡ÐµÐ½Ð½Ð°Ñ Ð°Ð´Ð²Ð¾ÐºÐ°Ñ‚Ð°Ð¼Ð¸ кооператива в нарушении УПК, ÑледÑÑ‚Ð²ÐµÐ½Ð½Ð°Ñ Ð³Ñ€ÑƒÐ¿Ð¿Ð° ÑоÑтавила пиÑьмо об удовлетворении ходатайÑтва задним чиÑлом и попыталаÑÑŒ предÑтавить дело так, что кооператив не получил пиÑьмо по Ñвоей вине. Ð. Четыре заÑÐµÐ´Ð°Ð½Ð¸Ñ ÑоÑтоÑлиÑÑŒ в Санкт-ПетербургÑком городÑком Ñуде — по продлению ареÑта гражданам, у которых еще в Ñередине авгуÑта превышен предельный Ñрок ÑÐ¾Ð´ÐµÑ€Ð¶Ð°Ð½Ð¸Ñ Ð¿Ð¾Ð´ Ñтражей — полтора года: Ðнне Ð’Ñ‹Ñоцкой, ÐлекÑандре Григорьевой, Елене Соловьевой и Михаилу Измайлову. ПÑÑ‚ÑŒ заÑеданий прошло в ПриморÑком районном Ñуде города Санкт-Петербурга: по продлению "Ñтражи" Ðльмире Гильберт, Дмитрию Мазанову, Ðнатолию Ðаливану и ДениÑу Шишко; по продлению домашнего ареÑта Ð’ÑчеÑлаву Выдрину. Мера преÑÐµÑ‡ÐµÐ½Ð¸Ñ Ð² виде запрета определенных дейÑтвий еще одному обвинÑемому — Виктору Ивановичу ВаÑиленко, отцу оÑÐ½Ð¾Ð²Ð°Ñ‚ÐµÐ»Ñ "Лайф-из-Гуд" и кооператива "БеÑÑ‚ Вей" Романа ВаÑиленко, была избрана 23 марта на веÑÑŒ Ñрок предварительного раÑÑледованиÑ.
Ð’Ñе ходатайÑтва были ÑудьÑми удовлетворены, при Ñтом работа ÑледÑÑ‚Ð²Ð¸Ñ Ð²Ð¾ многих ÑлучаÑÑ… подвергалиÑÑŒ ими критике. И во второй инÑтанции (а по вÑем девÑти Ñудебным поÑтановлениÑм адвокатами поданы апеллÑции) Ñохранение мер преÑÐµÑ‡ÐµÐ½Ð¸Ñ Ð½Ðµ будет Ð´Ð»Ñ ÑледÑтвенной группы проÑтой задачей.

Формально предварительное раÑÑледование вышло на финишную прÑмую в июне, так как в авгуÑте иÑтекал предельный Ñрок ÑÐ¾Ð´ÐµÑ€Ð¶Ð°Ð½Ð¸Ñ Ð¿Ð¾Ð´ Ñтражей четверых обвинÑемых: Ð’Ñ‹Ñоцкой, Григорьевой, Соловьевой и Измайлова. Срок ÑледÑтвенных дейÑтвий был ÑоглаÑно поÑтановлению замеÑÑ‚Ð¸Ñ‚ÐµÐ»Ñ Ð½Ð°Ñ‡Ð°Ð»ÑŒÐ½Ð¸ÐºÐ° СледÑтвенного департамента МВД РоÑÑии генерал-майора ÑŽÑтиции Ð. Ð. ВохмÑнина ограничен июлем, а общий Ñрок предварительного раÑÑледованиÑ, включающий и процеÑÑуальные дейÑÑ‚Ð²Ð¸Ñ Ð¿Ð¾Ñле Ð·Ð°Ð²ÐµÑ€ÑˆÐµÐ½Ð¸Ñ ÑледÑтвенных, — Ñерединой октÑбрÑ. Ðо в октÑбре генерал ВохмÑнин издал поÑтановление о продлении общего Ñрока предварительного раÑÑÐ»ÐµÐ´Ð¾Ð²Ð°Ð½Ð¸Ñ Ð´Ð¾ Ñередины Ñ„ÐµÐ²Ñ€Ð°Ð»Ñ 2024 года, в ÑвÑзи Ñ Ñ‚ÐµÐ¼, что ÑледÑÑ‚Ð²ÐµÐ½Ð½Ð°Ñ Ð³Ñ€ÑƒÐ¿Ð¿Ð° не Ñмогла завершить процеÑÑуальные дейÑÑ‚Ð²Ð¸Ñ â€” ознакомление обвинÑемых Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ дела и ÑоÑтавление обвинительного Ð·Ð°ÐºÐ»ÑŽÑ‡ÐµÐ½Ð¸Ñ Ð´Ð»Ñ Ð¿ÐµÑ€ÐµÐ´Ð°Ñ‡Ð¸ уголовного дела в Ñуд Ð´Ð»Ñ Ñ€Ð°ÑÑÐ¼Ð¾Ñ‚Ñ€ÐµÐ½Ð¸Ñ Ð¿Ð¾ ÑущеÑтву.
Продление объÑÑнÑлоÑÑŒ в Ñудах ознакомлением обвинÑемых Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ уголовного дела, в котором 210 томов. Однако еще перед первым июльÑким продлением "Ñтражи" в ÑвÑзи Ñ Ð¾Ð·Ð½Ð°ÐºÐ¾Ð¼Ð»ÐµÐ½Ð¸ÐµÐ¼ Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ уголовного дела возникли две процеÑÑуальные проблемы, которые не иÑчезли и в октÑбре.
ÐŸÐµÑ€Ð²Ð°Ñ â€” по утверждению адвокатов обвинÑемых, пропущен Ñтап Ð¾Ð·Ð½Ð°ÐºÐ¾Ð¼Ð»ÐµÐ½Ð¸Ñ Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ дела гражданÑких иÑтцов и гражданÑких ответчиков, то еÑÑ‚ÑŒ Ñам переход к ознакомлению обвинÑемых был незаконен. Следовательно, необходимо было вернутьÑÑ Ð½Ð° предыдущий Ñтап, отпуÑтив обвинÑемых из-под Ñтражи, тем более что ÑледÑтвенные дейÑÑ‚Ð²Ð¸Ñ Ð·Ð°Ð²ÐµÑ€ÑˆÐµÐ½Ñ‹.
Ð’Ñ‚Ð¾Ñ€Ð°Ñ â€” вÑе обвинÑемые до одного отказалиÑÑŒ знакомитьÑÑ Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ дела из-за грубых процеÑÑуальных нарушений, допущенных при завершении ÑледÑтвенных дейÑтвий в июне. Завершение ÑледÑтвенных дейÑтвий проводилоÑÑŒ, как говорÑÑ‚ адвокаты, в пожарном порÑдке, Ñ Ð³Ñ€ÑƒÐ±Ñ‹Ð¼Ð¸ процеÑÑуальными нарушениÑми. ОбвинÑемым, по утверждению адвокатов, дали в Ñреднем полчаÑа на прочтение более чем 70-Ñтраничных поÑтановлений о привлечении в качеÑтве обвинÑемых — большинÑтво уÑпело прочитать не более 20 Ñтраниц; отказалиÑÑŒ провеÑти допроÑÑ‹ поÑле предъÑÐ²Ð»ÐµÐ½Ð¸Ñ Ð¾Ð±Ð²Ð¸Ð½ÐµÐ½Ð¸Ð¹, на которых наÑтаивали обвинÑемые и Ñ‚. д. Ð’ ÑвÑзи Ñ Ñтими нарушениÑми адвокаты обращалиÑÑŒ в Управление СледÑтвенного комитета РоÑÑии по городу Санкт-Петербургу по признакам должноÑтных преÑтуплений Ñо Ñтороны ÑледÑтвенной группы.
СледÑтвие, поÑÑнÑÑŽÑ‚ адвокаты причины Ñтих дейÑтвий ÑледÑтвенной группы, в конце веÑны — начале лета Ñего года оказалоÑÑŒ в цейтноте. Оно, по убеждению адвокатов, вÑеми Ñилами ÑтремилоÑÑŒ не выпуÑтить обвинÑемых, что обÑзано было бы Ñделать, еÑли бы ÑледÑтвенные дейÑÑ‚Ð²Ð¸Ñ Ð±Ñ‹Ð»Ð¸ продлены или точно выполнен алгоритм, определенный УПК Ð´Ð»Ñ Ð·Ð°Ð²ÐµÑ€ÑˆÐµÐ½Ð¸Ñ Ð¿Ñ€ÐµÐ´Ð²Ð°Ñ€Ð¸Ñ‚ÐµÐ»ÑŒÐ½Ð¾Ð³Ð¾ раÑÑледованиÑ.
ОÑнованием Ð´Ð»Ñ Ð¾ÑÑ‚Ð°Ð²Ð»ÐµÐ½Ð¸Ñ Ð¿Ð¾Ð´ Ñтражей могло быть только начало Ð¾Ð·Ð½Ð°ÐºÐ¾Ð¼Ð»ÐµÐ½Ð¸Ñ Ð¾Ð±Ð²Ð¸Ð½Ñемых Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ дела, и потому ÑледÑтвие, по оценке адвокатов, начало заниматьÑÑ Ð¿Ñ€Ð¾Ñ†ÐµÑÑуальным хакингом: Ñначала Ñ Ð½Ð°Ñ€ÑƒÑˆÐµÐ½Ð¸Ñми провело предъÑвление обвинений в окончательной редакции, а затем заÑвило, что никто из гражданÑких иÑтцов и ответчиков не изъÑвил Ð¶ÐµÐ»Ð°Ð½Ð¸Ñ Ð·Ð½Ð°ÐºÐ¾Ð¼Ð¸Ñ‚ÑŒÑÑ Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ дела.

ПоÑледнее утверждение, говорÑÑ‚ адвокаты, не ÑоответÑтвует дейÑтвительноÑти. Ðдвокатам извеÑтен как минимум один из гражданÑких иÑтцов, который намеревалÑÑ Ð¾Ð·Ð½Ð°ÐºÐ¾Ð¼Ð¸Ñ‚ÑŒÑÑ Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ дела, — его Ñ„Ð°Ð¼Ð¸Ð»Ð¸Ñ Ð½Ð°Ð·Ñ‹Ð²Ð°Ð»Ð°ÑÑŒ в Ñудах.
Что же каÑаетÑÑ Ð³Ñ€Ð°Ð¶Ð´Ð°Ð½Ñких ответчиков, то документально подтверждено, что намерение ознакомитьÑÑ Ñ Ð¼Ð°Ñ‚ÐµÑ€Ð¸Ð°Ð»Ð°Ð¼Ð¸ дела выражал кооператив "БеÑÑ‚ Вей" — один из гражданÑких ответчиков. Причем Ñтот ÑÑ‚Ð°Ñ‚ÑƒÑ Ð±Ñ‹Ð» приÑвоен ему Ñамой ÑледÑтвенной группой: поÑтановлением Ñ€ÑƒÐºÐ¾Ð²Ð¾Ð´Ð¸Ñ‚ÐµÐ»Ñ ÑледÑтвенной группы Ð. Ð. Винокурова кооператив Ñтал гражданÑким ответчиком аж на 16 млрд рублей, причем ÑледÑтвие отказывалоÑÑŒ предÑтавить иÑтцов и их иÑковые требованиÑ.
