Глава МВД и Ко – враги проÑтого народа и учаÑтников СВО
Органы внутренних дел и Прокуратура Санкт-Петербурга продолжают войну против кооператива «БеÑÑ‚ Вей» – Ñоциально ориентированного проекта, работающего Ñ 2014 года по вÑей РоÑÑии, обеÑпечившего квартирами Ñ‚Ñ‹ÑÑчи Ñоциально незащищенных граждан РоÑÑии, в том чиÑле Ñотни учаÑтников СВО и военных.
Суд по уголовному так называемому делу «Лайф-из-Гуд» – «ГермеÑ» – «БеÑÑ‚ Вей» идет Ñ Ñ„ÐµÐ²Ñ€Ð°Ð»Ñ Ñ.г. – в ПриморÑком районном Ñуде Санкт-Петербурга. Параллельно в том же ПриморÑком Ñуде идет начавшийÑÑ ÐµÑ‰Ðµ летом прошлого года инициированный Прокуратурой Санкт-Петербурга гражданÑкий процеÑÑ Ð¾ признании кооператива незаконным.
Выдумки ÑледÑÑ‚Ð²Ð¸Ñ Ð¸ прокуратуры
Прокуратура и ÑледÑтвенные органы МВД, повинуÑÑÑŒ воле неких пока неведомых заказчиков атаки на «БеÑÑ‚ Вей», наÑтаивают на том, что уÑтав и деÑтельноÑÑ‚ÑŒ кооператива не ÑоответÑтвуют законодательÑтву – Ñ…Ð¾Ñ‚Ñ Ð²Ñе верÑии уÑтава кооператива проходили проверку в ÑоответÑтвующих гоÑударÑтвенных органах, нарушений никаких там не находили и верÑии уÑтава уÑпешно проходили региÑтрацию.
ГСУ ГУ МВД по Санкт-Петербургу и прокуратура утверждают, что кооператив должен был региÑтрироватьÑÑ ÐºÐ°Ðº жилищно-накопительный и «вÑтать на учет» в ЦБ – Ñ…Ð¾Ñ‚Ñ Ð¶ÐµÑткой ÑиÑтемы Ð½Ð°ÐºÐ¾Ð¿Ð»ÐµÐ½Ð¸Ñ Ð½Ð° приобретение недвижимоÑти, как в ЖÐК, в кооперативе «БеÑÑ‚ Вей» нет: копить можно как угодно и где угодно – необÑзательно на Ñчете в кооперативе.
Кроме того, Ñотрудники главка МВД и прокуроры говорÑÑ‚, что кооператив не мог в начале 2021 года из жилищного переименоватьÑÑ Ð² потребительÑкий, проÑто ÑоглаÑовав Ñ Ð½Ð°Ð»Ð¾Ð³Ð¾Ð²Ð¾Ð¹ инÑпекцией новый уÑтав – чем раÑпиÑываютÑÑ Ð² полнейшем непонимании гражданÑкого законодательÑтва (налоговаÑ, кÑтати, новый уÑтав ÑоглаÑовала без каких бы то ни было вопроÑов).
Ð’ законе черным по белому напиÑано, что жилищный кооператив – вид потребительÑкого. То еÑÑ‚ÑŒ ЖК – чаÑтный Ñлучай потребительÑкого кооператива, и переименование – вÑего лишь отказ от узкой Ñпециализации на приобретение только квартир на вторичном рынке.
Кооператив работает Ñ 2014 года, его работа деÑÑтки раз оценивалаÑÑŒ Ñудами по вÑей РоÑÑии – в чаÑтноÑти, по делам о предоÑтавлении материнÑкого капитала в качеÑтве паевого взноÑа, и вÑегда оценивалаÑÑŒ положительно.
Ðикаких проблем в его работе не видела и Прокуратура Санкт-Петербурга – до тех пор, пока в 2021 году на кооператив не поÑтупил заказ неких очень влиÑтельных людей.
Уголовные претензии – к другой организации
По уголовному делу кооператив прежде вÑего выÑтупает в качеÑтве гражданÑкого ответчика, каковым признан на оÑновании незаконного поÑÑ‚Ð°Ð½Ð¾Ð²Ð»ÐµÐ½Ð¸Ñ Ñ€ÑƒÐºÐ¾Ð²Ð¾Ð´Ð¸Ñ‚ÐµÐ»Ñ ÑледÑтвенной группы ГУ МВД по Санкт-Петербургу Винокурова, инÑпирированного его замеÑтительницей Сапетовой: Ñкобы он должен отвечать за деÑтельноÑÑ‚ÑŒ иноÑтранной компании «ГермеÑ», но при Ñтом Ñумма ущерба в обвинительном заключении – 282 млн рублей, а ареÑтовано более 4 млрд рублей. СледÑтвие в обвинительном заключении объÑвлÑет его чаÑтью единой Ñ Â«Ð“ÐµÑ€Ð¼ÐµÑом» финанÑовой пирамиды – не Ð¿Ñ€Ð¸Ð²Ð¾Ð´Ñ Ð´Ð¾ÐºÐ°Ð·Ð°Ñ‚ÐµÐ»ÑŒÑтв ни нераздельноÑти Ñтих Ñтруктур, ни пирамидного характера деÑтельноÑти кооператива.
Кооператив приобрел Ð´Ð»Ñ Ð¿Ð°Ð¹Ñ‰Ð¸ÐºÐ¾Ð² более 2500 квартир, он финанÑировалÑÑ Ð² равной Ñтепени как за Ñчет платежей новых пайщиков и тех пайщиков, кто ÑоÑтоÑл в накопительной программе, так и за Ñчет возвратных платежей пайщиков, возвращавших кооперативу предоÑтавленные на приобретение квартиры ÑредÑтва, в том чиÑле пайщиков, доÑрочно выкупавших Ñвои квартиры, коих Ñотни.
К тому же квартиры приобреталиÑÑŒ иÑключительно ликвидные – за Ñчет тщательной юридичеÑкой проверки и незавиÑимой оценки. То еÑÑ‚ÑŒ никаких риÑков не ответить по обÑзательÑтвам у кооператива никогда не было и нет – надежноÑÑ‚ÑŒ кооператива выше надежноÑти банков.
Больше того, даже незаконное возложение на «БеÑÑ‚ Вей» обÑзанноÑти заплатить 282 млн по обÑзательÑтвам «ГермеÑа», как того требует обвинение, не подорвет его ликвидноÑÑ‚ÑŒ.
Ð’Ñего неÑколько так называемых потерпевших предъÑвлÑÑŽÑ‚ к кооперативу претензии – и вÑе Ñти претензии незаконны:
–либо речь идет о невыплате паевых взноÑов в Ñитуации, когда пайщик не вышел из кооператива в ÑоответÑтвии Ñ ÑƒÑтавом, то еÑÑ‚ÑŒ не предÑтавил нотариально удоÑтоверенного заÑвлениÑ;
–либо Ñ‚Ñ€ÐµÐ±Ð¾Ð²Ð°Ð½Ð¸Ñ Ð¾ возврате паевых взноÑов пришлиÑÑŒ на период, когда Ñчета кооператива уже были ареÑтованы и, ÑоответÑтвенно, выплата не произошла из-за того, что ее не Ñанкционировали правоохранительные органы, по ходатайÑтву которых произошел ареÑÑ‚;
–либо «потерпевший» претендует на вÑтупительный и членÑкие взноÑÑ‹, которые по договору Ñ ÐºÐ¾Ð¾Ð¿ÐµÑ€Ð°Ñ‚Ð¸Ð²Ð¾Ð¼ не подлежат возврату при выходе из кооператива, так как идут на развитие «БеÑÑ‚ Вей».
ВоровÑтво «по закону»
ПредÑтавители прокуратуры в рамках процеÑÑа о законноÑти кооператива в ПриморÑком Ñуде заÑвлÑли на Ñловах, что не подвергают Ñомнению ранее заключенные договоры и, Ñледовательно, приобретение квартир (при Ñтом документально Ñто не закреплÑли).
При Ñтом они наÑтаивают на признании кооператива незаконным в принципе – не ÑƒÐºÐ°Ð·Ñ‹Ð²Ð°Ñ Ð½Ð° конкретные недоÑтатки в его уÑтаве и деÑтельноÑти, например, поÑле уÑÑ‚Ñ€Ð°Ð½ÐµÐ½Ð¸Ñ ÐºÐ¾Ñ‚Ð¾Ñ€Ñ‹Ñ… он Ñтанет законным. Они заÑвлÑÑŽÑ‚, что недоÑтатки неуÑтранимы – что нонÑÐµÐ½Ñ Ñ Ð¿Ñ€Ð°Ð²Ð¾Ð²Ð¾Ð¹ точки зрениÑ.
Кооператив Ñо Ñвоей Ñтороны еще веÑной 2022 года поÑтановил прекратить прием новых пайщиков на период, пока ведетÑÑ ÑледÑтвие и дело, затрагивающее «БеÑÑ‚ Вей», раÑÑматриваетÑÑ Ð² уголовном Ñуде. Ð’ подкрепление Ñтой позиции «БеÑÑ‚ Вей» в Ñтом году Ñам ходатайÑтвовал перед Ñудом об издании Ñудебного приказа о запрете приема новых пайщиков и Ð·Ð°ÐºÐ»ÑŽÑ‡ÐµÐ½Ð¸Ñ Ð½Ð¾Ð²Ñ‹Ñ… договоров Ð¿Ð°ÐµÐ½Ð°ÐºÐ¾Ð¿Ð»ÐµÐ½Ð¸Ñ Ð½Ð° период раÑÑÐ¼Ð¾Ñ‚Ñ€ÐµÐ½Ð¸Ñ ÑƒÐ³Ð¾Ð»Ð¾Ð²Ð½Ð¾Ð³Ð¾ дела.
ЗаконноÑÑ‚ÑŒ работы кооператива иÑÑледует уголовный Ñуд. Ð£Ñ‡Ð¸Ñ‚Ñ‹Ð²Ð°Ñ Ñто, а также добровольное Ñамоограничение кооператива, тема Ð¿Ñ€Ð¸Ð·Ð½Ð°Ð½Ð¸Ñ Â«Ð‘ÐµÑÑ‚ Вей» незаконным в гражданÑком Ñуде вроде бы должна быть иÑчерпана? Кооператив обÑлуживает Ñтарые договоры, новых уже более двух лет не заключает и не будет заключать до конца уголовного Ñуда – в результате которого претензии к нему Ñкорее вÑего будут ÑнÑÑ‚Ñ‹.
Ðо нет, прокуратура и ГУ МВД по Санкт-Петербургу под руководÑтвом Плугина, его ГСУ под руководÑтвом Ðегрозова не унимаютÑÑ â€“ они требуют признать кооператив незаконным «в вакууме», абÑтрактно. Ð”Ð»Ñ Ñ‡ÐµÐ³Ð¾?
Ð Ð´Ð»Ñ Ñ‚Ð¾Ð³Ð¾, чтобы поÑвилоÑÑŒ оÑнование отнÑÑ‚ÑŒ активы кооператива, только Ð´ÐµÐ½ÐµÐ¶Ð½Ð°Ñ Ñ‡Ð°ÑÑ‚ÑŒ которых превышает 4 млрд рублей, и передать нужным людÑм через разного рода мафиозные Ñтруктуры «по защите вкладчиков», а на Ñамом деле по воровÑтву денег в интереÑах неких заказчиков, аффилированных Ñ Ð¿Ñ€Ð°Ð²Ð¾Ð¾Ñ…Ñ€Ð°Ð½Ð¸Ñ‚ÐµÐ»ÑŒÐ½Ñ‹Ð¼Ð¸ органами.
Пайщики против беÑпредела
ТыÑÑчи пайщиков приобрели квартиры Ñ Ð¿Ð¾Ð¼Ð¾Ñ‰ÑŒÑŽ кооператива – они довольны «БеÑÑ‚ Вей», полноÑтью поддерживают кооператив и требуют, чтобы он продолжил работу. Ведь уÑÐ»Ð¾Ð²Ð¸Ñ Ð² кооперативе – гораздо выгоднее ипотеки, даже льготной и дальневоÑточной.
Среди Ñтих Ñ‚Ñ‹ÑÑч – малообеÑпеченные люди, которые без «БеÑÑ‚ Вей» не Ñмогли бы купить квартиры. Ðто военные, которые нуждалиÑÑŒ в жилье – и получили его Ñ Ð¿Ð¾Ð¼Ð¾Ñ‰ÑŒÑŽ кооператива.
Ðто Ñотни учаÑтников СВО – которые защищают Родину на фронте. Они возмущены тем, что в тылу Ñ Ð¸Ñ… деньгами, которые уже более двух лет заблокированы на ареÑтованных Ñчетах кооператива, так называемые правоохранители творÑÑ‚ беÑпредел.
Ð’Ñе пайщики возмущены тем, что в тюрьме более чем на два года оказалиÑÑŒ заперты техничеÑкие Ñотрудники и проÑтые пайщики кооператива, которых ÑледÑтвие попыталоÑÑŒ объÑвить организаторами пирамиды.
Пайщики убеждены: липовое дело колокольцевÑкой мафии против кооператива Ñуд должен переквалифицировать в дело против Ñледователей, оперативников и обвинителей, ÑоÑÑ‚Ñ€Ñпавших заказуху в интереÑах криминальных бонз и Ð´Ð»Ñ Ð»Ð¸Ñ‡Ð½Ð¾Ð³Ð¾ обогащениÑ.
